NXTGEN BASEBALL CAMP
WAIVER OF LIABILITY, RELEASE, ASSUMPTION OF RISK, INDEMNITY AGREEMENT & CONSENT TO MEDICAL TREATMENT

READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS
REQUIRED FOR PARTICIPATION

In consideration of being permitted to participate in any way in the NxtGen Baseball Camp (the “Camp”), I, the undersigned participant (or parent/legal guardian if the participant is under 18 years of age), acknowledge and agree to the following terms and conditions:

1. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

I understand that participation in athletic and recreational activities, including those provided by the Camp, involves inherent risks, including but not limited to physical injury, illness, permanent disability, and death. These risks may arise from my own actions, inactions, or negligence, as well as the actions, inactions, or negligence of others, or the condition of the facilities or equipment.

I VOLUNTARILY AND KNOWINGLY ASSUME ALL SUCH RISKS, whether known or unknown, and fully accept personal responsibility for any injury, loss, or damage that may occur during participation.

I, on behalf of myself and/or my child, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Ryan Rowland-Smith, NxtGen Baseball, its officers, directors, staff, contractors, volunteers, representatives, affiliates, and any associated facilities or personnel (collectively referred to as the “Releasees”), from any and all claims, demands, liabilities, losses, damages, or causes of action of any kind, known or unknown, arising out of or related to participation in the Camp, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, and whether arising under the law of the United States, Australia, or any other jurisdiction.

2. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, liabilities, costs, expenses, or damages, including attorney’s fees and court costs, arising out of or related to my and/or my child’s participation in the Camp.

3. MEDICAL CONSENT

In the event of an emergency or non-emergency situation requiring medical care, I hereby authorize the Camp, its staff, and any affiliated medical personnel to administer or secure any necessary medical treatment for myself and/or my child. This includes the use of over-the-counter medications or prescription medications brought to the Camp by the participant in original containers with dosage instructions.

I understand that I am responsible for all medical expenses incurred, whether covered by insurance or not, and that the Releasees are not responsible for such costs.

4. MEDIA RELEASE

I grant permission to NxtGen Baseball to photograph, film, or otherwise capture the likeness or voice of myself and/or my child during Camp activities. I authorize NxtGen Baseball to use such images or recordings for promotional, commercial, or informational purposes, including but not limited to social media, print, and web-based publications, without compensation.

5. LEGAL JURISDICTION AND SEVERABILITY

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, USA, and the Commonwealth of Australia, depending on the location of the Camp and the participant's country of residence. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in the appropriate location.

If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

6. ACKNOWLEDGEMENT OF UNDERSTANDING

By signing below, I affirm that:

• I have read and understand this Waiver and Release in its entirety;

• I voluntarily agree to its terms without duress or coercion;

• I am 18 years of age or older, or the parent/legal guardian of the participant listed below;

• I understand that I am waiving legal rights by signing this document.
